NOTICE OF MOTION TO REVIEW
AND VARY THE PRICE CAP PLAN 2016 DECISION  
 
No. 001 of 2018  
 
IN THE MATTER of the Fair Trading Commission Act, CAP.326B of the Laws of Barbados;  
 
AND IN THE MATTER of the Utilities Regulation Act, CAP.282 of the Laws of Barbados;  
 
AND IN THE MATTER of the Utilities Regulation (Procedural) Rules, 2003 and the Utilities Regulation (Procedural) (Amendment) Rules, 2009;  
 
AND IN THE MATTER of an Application by Cable & Wireless (Barbados) Limited for a review and variation of the Price Cap Plan Decision dated the 31st day of March 2016.  
 
NOTICE IS HEREBY GIVEN that:
Cable & Wireless (Barbados) Limited (C&W) by a Notice of Motion dated and filed on the 29th of August 2017, applied for a review of the Commission’s Decision on the Price Cap Plan 2016 FTC/UR/DEC/2016-01 and the Price Cap Plan 2016 Compliance Rules and Procedures FTC/UR/PCP/2016-02 (Application).This Application proposes a change in the Statutory Financial Year from April 1 - March 31 to January 1 - December 31 of each year and a corresponding change in the regulatory reporting periods set out in the Price Cap Plan Decision 2016 and Price Cap Plan Compliance Rules and Procedures.
 
The Application in addition to the Commission’s Decision on the Price Cap Plan 2016 and the Price Cap Plan Compliance Rules and Procedures are available on the Commission’s website at www.ftc.gov.bb or at its office at “Good Hope”, Green Hill, St. Michael between the hours of 9:00a.m. and 4:00 p.m., Mondays through Fridays. Persons wishing to comment on this Application are asked to submit written comments on or before Friday, January 26, 2018.  
 
The Commission will determine both the threshold question and review on the merits via written hearing pursuant to Rule 37 of the Utilities Regulation (Procedural) Rules, 2003.
