FTC FAIR COMPETITION RESPONSE TO COVID-19: SELF ASSESSMENT FOR BUSINESS COLLABORATION DURING THE COVID-19 PANDEMIC
 

The Fair Trading Commission (the Commission) wishes to remind the public that, under Section 13 of the Fair Competition Act, CAP. 326C, collaboration among competitors is prohibited. However, due to the COVID-19 pandemic, the Commission may allow collaboration between competitors under strict conditions. Businesses that are desirous of combining resources to provide relief to the public should ensure that the planned collaboration satisfies the following:

  • ONLY caters to areas affected by the pandemic
  • Assists with the provision of essential goods and services to customers, essential/front line workers and persons at risk
  • Solely benefits the public
  • Ensures security of supply (prevents shortage)
  • Does not present with any other form of anticompetitive conduct (e.g. price fixing, tied selling, collusion, intentional exclusion of other businesses)
  • Does not extend to areas or procedures not affected by the pandemic
