Case Opened: November 2008

Digicel complained to the Commission that LIME was offering to the public a package that included 6000 minutes of talk for BDS$115. The concern with this promotion was that it included calls from mobile to the land line and in so doing could not be matched by LIME’s mobile competitors because of the interconnection costs. In effect Digicel was suggesting that LIME could not be charging its mobile arm the same interconnection rates that its competitors were obligated to pay. 

The Commission, having received and analysed information on the historical usage patterns of customers, found that these patterns did not support the take up of the offer in the manner alleged by Digicel. It was accepted that even with an extremely enthusiastic response to the offer, usage patterns were unlikely to reach the levels alleged by Digicel.

The Commission concluded that LIME’s offer was unlikely to have any distorting effect on competition.
