Allegation: Anti-competitive Business Conduct by Digicel PDF Print

Case Opened: February 3, 2010

The Commission has completed its investigation into the allegation that Digicel (Barbados) Limited (Digicel) in sending a Short Message Service (SMS) text message to its customers containing content that was inaccurate and malicious, engaged in conduct likely to disrupt competition within the market for the supply of mobile telecommunications services in Barbados.

The Commission found that the content of the message sent by Digicel describes the general extent of Cable & Wireless (Barbados) Limited trading as LIME’s action and further that, Digicel’s actions may be viewed as ‘normal’ practice between keen rivals in a competitive market.

The Commission therefore found that, Digicel did not breach Section 13 (1) of the Fair Competition Act CAP 326C.

Case Closed: March 1, 2010
