PUBLIC NOTICE

FTC INVESTIGATION OF COST-U-LESS ADVERTISING COMPLETED

The Fair Trading Commission (the Commission) has completed its investigations into advertisements previously placed in the media by Cost-U-Less relating to the sale of canned 14. 75 oz. Bumble Bee Salmon (the “Product”). Cost-U-Less advertised that the product would be sold at $ 6.99 as a part of their Monthly deals promotion. However, it was reported that this product was not available on the first day of the sale.

The Commission has determined that Cost-U-Less engaged in conduct, which may have been contrary to the Consumer Protection Act, CAP. 326D of the Laws of Barbados (“CPA”), given that the Product was not available for purchase.

Noting the Commission’s concerns and as a sign of commitment to Barbadian consumers, Cost-U-Less has agreed to develop and implement a compliance policy that is consistent with the CPA, to monitor future advertisements and promotional materials. The FTC will have continued engagement with Cost-U-Less on this compliance policy for a period of two years from the date of implementation.

Cost-U-Less has indicated its appreciation for the Commission’s guidance and the Commission thanks Cost-U-Less for its co-operation in this matter.
